Our Privacy Pledge to You
This policy governs the operations of Frontier Bank, FSB (Utah), and Frontier Bank, FSB d.b.a. El Paseo Bank (California) collectively referred to hereafter as "The Bank".
At the Bank, the basis of each customer or consumer relationship is trust. You are considering, or currently are, doing business with the Bank, and we are obligated to honor that relationship with great care, beginning with the information you share with us. We believe that your privacy should not be compromised. At the same time, we want to offer you the array of financial products and services you need to accomplish your financial objectives. We believe we can do both through the privacy policy outlined below.
Maintenance of Accurate Information
The Bank has established procedures to ensure that your financial information is accurate, current and complete. We also pledge to respond to requests to correct inaccurate information in a timely manner.
Limitations on Employee Access to Information
Employee access to personally identifiable customer information is limited to those with a business reason to know such information. Employees are educated on the importance of maintaining the confidentiality of your information. Employees are responsible for maintaining the confidentiality of customer information and those who violate this privacy policy will be subject to disciplinary measures.
Protection of Information via Established Security Procedures
The Bank is committed to the security of your financial and personal information. All of our operational and data-processing systems are in a secure environment that protects account information from being accessed by third parties. We maintain and grant access to customer information only in accordance with our internal security standards.
Access to your account information via the Internet is protected by a user I.D. password and 128-bit encryption technology. Customers must apply for this service and become registered with the Bank for authentication purposes.
The Bank may link its web site to other sites. In no event, however, can the Bank assume responsibility for the content of those sites nor their policies for the collection of customer information.
Collection and Use of Information
The Bank collects, retains, and uses your information only where it will help administer our business or provide you with products, services and other opportunities. The collection and retention of information is performed only for specific business purposes, and the Bank will define that purpose when asked. Information is used to protect and administer customer records, accounts and funds; to comply with certain laws and regulations; to assist in the development and/or improvement of products and services; and to understand the financial needs of our customers in order to provide useful products and quality services.
We collect the following kinds of information:

Restrictions on the Disclosure of Account Information
The Bank does not disclose any non-public personal information about its present or former customers to anyone except as permitted by law. We may, for example, disclose nonpublic personal information about customers to others for purposes of servicing their accounts with us, processing transactions that they request or authorize, or conducting credit or other verification checks.
Availability of Our Privacy Pledge
The Bank values its business relationships and wants all present and prospective customers to understand how it uses information gathered and its corresponding commitment to privacy. Bank personnel are available to answer questions about our use of customer information.
Internet Banking Agreement and Disclosure
This Internet Banking Agreement and Disclosure ("the Agreement") explains the terms and conditions governing the basic Internet banking services offered by Frontier Bank, FSB ("the Bank"). All Internet banking services of any kind whatsoever offered or afforded by the Bank will be referred to collectively as "Internet Banking Services" in the Agreement. By using any of the Internet Banking Services, you agree to abide by the terms and conditions of this Agreement and authorize the Bank to use any of your accounts to execute and settle transactions and/or fees initiated by you using the Internet Banking Services. The term "Business day" means all days except Saturday, Sunday and all banking holidays.
All Internet banking services are governed by this Agreement, all applicable federal regulatory disclosures, and the Deposit Account Terms and Conditions. All applicable fee schedules published by the Bank from time to time will apply to the Internet Banking Services. You are responsible for the payment of any fees incurred by you on any account, for any service, at any time. You agree to pay all such fees assessed by the Bank. Further, you agree to pay all telephone charges or fees incurred by you in accessing Internet Banking Services.
Your initial use of any Internet Banking Services in connection with your account at the Bank constitutes your acceptance and agreement to be bound by all of the terms and conditions of this Agreement and of the Deposit Account Terms and Conditions. Such initial use acknowledges your receipt and understanding of this Agreement and Deposit Account Terms and Conditions.
You agree that the Bank may, as permitted by law, provide all applicable disclosures to you electronically. You are responsible for downloading or printing the disclosures or providing the Bank with a non-electronic address to which the disclosures may be mailed.
The Bank is entitled to act upon instructions received through any Internet Banking Service under your password and without inquiring into the identity of the person using that password. However, you agree that you will not, under any circumstances, disclose your password by telephone or any other means to any person. You acknowledge that no person from the Bank will ever ask for your password, that Bank employees do not need and should not ask for your password. You agree never to provide your password to anyone, including anyone claiming to represent the Bank. You are liable for all transactions made or authorized using your password. The Bank has no responsibility for establishing the identity of any person or determining the validity of any transaction.
You agree that if you give your password to anyone or fail to safeguard its secrecy, you do so at your own risk since anyone with your password will have access to your accounts. You agree to notify the Bank immediately in the event your password is compromised. At any time, you may ask the Bank to disable your password. For joint accounts, each person may have a separate password, or each may use a joint password. Each person on a joint account will be liable for all transactions that are made on that account. Each person on a joint account authorizes all transactions made by any other person on the account. Each person on a joint account agrees to be liable for the actions of the other person(s) on the account.
You hereby indemnify and release the Bank from any and all liability and agree not to make any claim against the Bank or bring any action against the Bank honoring or allowing any actions or transactions where you have authorized the person performing the action or transaction to use your account or when you have provided your password to that person. You agree to reimburse the Bank for any losses it suffers or any damages, injuries, costs or expenses it incurs (including attorney's fees) as a result of the Bank's honoring or allowing transactions on the account where the password was used.
The limitations of liability set forth in this Agreement are subject to, and limited by any state or federal law to the contrary.
The Bank has the right to modify or terminate this Agreement or the Deposit Account Terms and Conditions at any time. When making changes, the Bank will comply with all legal notice requirements. Once this Agreement is terminated, the Bank will not allow any additional Internet Banking Services. If this Agreement is modified, your continued use of the Account will represent your acceptance of the changes.
For determining the processing times of your transactions, every day is a business day except Saturday, Sunday and any Federal Holiday. If you do a transaction before 6:00pm on a day that we are open, we will consider that day to be the date of your transaction. However, if you process a transaction after 6:00pm or on a day we are not open, we will consider that the transaction was done on the next business day we are open.
